Visa Cancellation & Character: understand your next step.

A practical guide to the decisions, documents and questions that make a legal enquiry more useful.

By Talk to a Lawyer · Published 19 September 2026 · 4 minute read

A character or cancellation issue can arise from a notice asking for a response, a cancellation decision or circumstances connected with criminal proceedings. These stages have different requirements. Tell the adviser exactly what document arrived, when it was received and where you are, including any custody or detention issue.

Read. Prepare. Find an office.

Use this guide to organise your questions, then confirm the provider’s experience, availability and first-stage fee.

Identify the legal step before responding

Provide the full notice, reasons, attachments and notification details. Distinguish an invitation to comment from a final decision and any request concerning revocation. Ask what process is available and which date applies. Do not assume the time limit or response used in another case is suitable for your notice.

Coordinate the immigration and criminal record

Collect visa history, relevant court orders and sentencing material, along with information the notice asks you to address. Explain any ongoing criminal matter and existing representation. Ask how the advisers should coordinate and what evidence is required. A criminal lawyer's engagement should not be assumed to include specialised immigration advice or vice versa.

Prepare an accurate, evidence-based response

Ask which personal, family and other circumstances are relevant to the actual legal question and how they should be supported. Keep submissions factual and disclose prior applications and statements. Confirm who drafts, reviews and lodges the response and how receipt is verified. Request a staged fee covering the current notice separately from any later review or court proceedings.

Match supporting material to the notice's actual questions

Prepare a list of each issue raised in the notice and the factual material that may address it. Keep court records, immigration history and personal circumstances accurately dated and distinguish a proposed event from one already completed. Ask the specialist what is relevant to the applicable decision and whether further records are needed. General support letters may not answer the legal question by themselves. Make sure the final response is checked against earlier submissions and that responsibility for lodgement and confirmation is explicit.

Compare the scope and cost of advice

Verify the individual adviser's registration or legal practising authority before engaging, then compare a written scope for your actual visa or decision. An eligibility consultation, application and review require different work. Separate professional fees from government charges, assessments and translations. Ask how you approve information before submission and retain copies, and who is responsible for monitoring time-sensitive correspondence.

Pathway assessment
Ask which current option is being assessed, what facts remain unverified and what written explanation you receive before committing to application preparation.
Application or response
Confirm who gathers evidence, checks accuracy, lodges documents and responds to further requests, including what happens if circumstances or the proposed pathway change.
Review or legal proceedings
Check the available route, authority to represent you, specific stages included and whether a different practitioner or separate advice about current status is required.

What a focused enquiry looks like

A person receives a character-related notice while their criminal lawyer handles a separate proceeding. They seek a coordinated immigration assessment using the actual notice and court records rather than relying on an informal prediction about visa consequences.

Your preparation checklist

Gather what you already have. Mark missing records and uncertain dates rather than guessing; ask the office what it needs before sending sensitive documents.

A first enquiry you can adapt

I received [notice or cancellation decision] on [date] and am currently [location and custody status if relevant]. I need urgent advice on the available response. Can you assess the grounds, evidence and deadline and coordinate with my existing criminal adviser if needed?

Replace the bracketed details with accurate information. Keep the first message brief and confirm a secure channel for the full records.

Common questions about visa cancellation & character

Does a criminal outcome automatically answer the visa question?

No. Ask for immigration advice on the actual notice and law, coordinated with advice on the criminal matter.

Does requesting advice pause the response date?

No pause should be assumed. Raise the notice and date promptly and confirm who is responsible for any required action.
